Pricing or Typographical Errors

Oettinger North America (“Seller”) makes every reasonable effort to ensure that the product and pricing information provided on Seller’s website and in other sponsored material is correct and accurate.  Despite these efforts, pricing and typographical errors may arise.  Oettinger America cannot confirm the price of an item until after Buyer places the order.  In the event that an item is listed at an incorrect price or contains incorrect information due to an error in pricing or product information, Oettinger America reserves the right, at Seller’s sole discretion, to refuse or cancel any orders placed for that item.  In the event that an item is mispriced, Oettinger America may, at Seller’s discretion, either contact Buyer for instructions or cancel Buyer’s order.  Prices and availability are subject to change without notice.  Seller reserves the right to discontinue products as necessary because of quality, availability, price or any other reason.

Order Acceptance

Orders are not binding upon Seller until accepted by Seller.  In some cases Seller may be unable to accept an order.  Oettinger North America reserves the right to cancel any orders at Seller’s discretion for any cause or reason.  Buyer may be contacted for additional information or verification as required by Oettinger America to meets Seller’s criteria for order acceptance.

Buyer agrees to pay the total purchase price for the Products plus shipping.

Product Fitment

Oettinger North America provides the following specifications for all vehicle wheels they sell:  wheel diameter, wheel width, pitch center diameter, and wheel centerline offset.  Seller’s responsibility for wheel fitment extends only to the accuracy of the aforementioned specifications.  Buyer accepts all responsibility of ensuring that wheels fit Buyer’s vehicle.  Certain vehicle options and performance parts (e.g. brake kits) can cause additional fitment issues.  Wheels that have had tires mounted to them cannot be returned and will not be exchanged by Seller for any reason.

Product sold by Seller may not be compatible with certain vehicle options or aftermarket components.  If in doubt, Seller should contact Oettinger North America with fitment concerns prior to purchase.  In no situation will Seller be responsible for incompatibility of Seller’s product with aftermarket components.

Warranties

It is the intention of Oettinger North America to sell only quality products.  Oettinger North America offers a limited one-year warranty against defects in workmanship or materials.  This warranty does not cover labor, misuse, faulty installation, failure of related parts, or any product not purchased from Oettinger North America or any product outside the warranty period.  Customer must provide Seller with a copy of the original sales invoice as proof of purchase to qualify for a refund.  Seller will only replace or repair warranty items, no refunds will be given under any circumstances.  Oettinger North America or the product manufacturer will inspect or test all products prior to a warranty claim adjustment.  For qualifying products, Oettinger North America will, at Seller’s sole discretion, either repair the item or replace it.  Oettinger North America does not provide product warranty of any type for Oettinger product, or any other product manufacturer, that is not purchased from Seller.

No warranty claims will be processed until defective merchandise has been returned to Oettinger North America.  Merchandise will not be accepted, under any circumstances, unless Buyer has obtained an RMA (return merchandise authorization) number.  The RMA number must be clearly indicated on, or in close proximity to, the package label.  Merchandise sent to Seller without the RMA number clearly indicated will be refused.  An RMA application form can be found on Sellers website or Buyer may contact Oettinger North America via email to begin the RMA process.

 EXCEPT AS SET FORTH HEREIN OR IN ANY STATEMENT OF WORK THAT EXPRESSLY AMENDS SELLER'S WARRANTY, AND SUBJECT TO APPLICABLE LAW, SELLER MAKES NO OTHER, AND EXPRESSLY DISCLAIMS ALL OTHER, REPRESENTATIONS, WARRANTIES, CONDITIONS OR COVENANTS, EITHER EXPRESS OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, DURABILITY, TITLE, ACCURACY OR NON-INFRINGEMENT) ARISING OUT OF OR RELATED TO THE PERFORMANCE OR NON-PERFORMANCE OF THE PRODUCTS.  THIS DISCLAIMER AND EXCLUSION SHALL APPLY EVEN IF THE EXPRESS WARRANTY AND LIMITED REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE. CUSTOMER ACKNOWLEDGES THAT NO REPRESENTATIVE OF SELLER OR OF ITS AFFILIATES IS AUTHORIZED TO MAKE ANY REPRESENTATION OR WARRANTY ON BEHALF OF SELLER OR ANY OF ITS AFFILIATES THAT IS NOT IN THIS AGREEMENT OR IN A STATEMENT OF WORK EXPRESSLY AMENDING SELLER'S WARRANTY.

Returns

All returns must be within 30 days and are subject to a restocking fee of 25%.  Special order, clearance, and certain other items may not be returnable.  Buyer must obtain an RMA number from Seller before returning items.  The RMA number must be clearly indicated on, or in close proximity to, the package label.  An RMA application form can be found on Sellers website or Buyer may contact Oettinger North America via email to begin the RMA process.  Shipping costs will not be refunded for any reason.  All return shipments must be prepaid.  No refunds will be processed until merchandise has been received by Seller, inspected, and determined to meet all criteria defined herein.

All returned items must be in new condition and in original packaging.  Merchandise that has been installed on a vehicle, or wheels that have had tires mounted on them, will not be accepted for return under any situation.  Items received by Seller not meeting all criteria will be deemed non-returnable and Buyer accepts full responsibility for all shipping costs to deliver merchandise back to Buyer.  Abandoned merchandise may be claimed by Seller after sixty days.

Damage Claims

Oettinger North America makes all reasonable efforts to ensure that merchandise is in good condition when it leaves Seller’s facility. If an item is lost or damaged during transit, Buyer should immediately notify Seller and the carrier (UPS, USPS, etc.).  Seller ships all merchandise insured for full value.  The responsibility for proper delivery is upon the carrier.   Damaged merchandise should not be returned to Seller without prior approval.

Legality

Oettinger North America makes no claims as to emissions legality of any product sold.  Some equipment may not be appropriate for street or highway use.  Seller makes no claims as to the legality of road use of any product in any jurisdiction.

Limited Liability

Neither Oettinger North America nor Buyer shall be liable for incidental or consequential damages, including but not limited to, the cost of labor, vehicle damage, delay, lost profits, or loss of goodwill arising out of the sale, installation or use of any Oettinger product. If Oettinger North America has any liability for breach of contract, breach of any implied condition, warranty or representation, the aggregate liability of Oettinger North America to Buyer shall be limited in respect of any occurrence or series of occurrences to the contractual value of the products or services that are the subject of the contract.

Seller will not be responsible for and no liability shall result to Seller or any of its Affiliates for any delays in delivery or in performance which result from any circumstances beyond Seller’s reasonable control, including, but not limited to, Product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, embargo, acts of God or acts or laws of any government or agency. Any shipping dates or completion dates provided by Seller or any purported deadlines contained in a Statement of Work or any other document are estimates only.
